ORDER : The Court Made the following order :- This petition has been filed to modify the condition No.(ii) imposed in Crl.MP.No.125 of 2025 dated 15.05.2025 on the file of the learned Vacation Sessions Judge, Nagercoil.
2. The learned Counsel for the petitioner would submit that the petitioner has filed an anticipatory bail petition before the learned Vacation Sessions Judge, Nagercoil in Crl.MP.No.125 of 2025. The said bail petition was heard and on 15.05.2025, the trial Court was pleased to grant anticipatory bail to the petitioner with certain conditions. In the said anticipatory bail order, Condition No.(ii) as follows:
''(ii). After release, the petitioner shall Stay at Madurai, appear and sign before the Judicial Magistrate No.I, Madurai daily twice at 10.30.a.m and 05.00p.m. until further orders''
3. He further submits that this petitioner is a senior citizen aged about 69 years and he is suffering from various ailments and his health condition does not allow him to stay at Madurai. However, in obdience to the order passed by the learned Vacation Sessions Judge, Nagercoil, this petitioner has complied the said condition regularly for ten days. This petitioner is ready to appear before the respondent police and comply with the condition. Therefore, the petitioner seeks indulgence of 2/4
this court by modifying the said condition imposed against him. Hence, he prays for modification of the said condition.
4. The learned Government Advocate (Crl.side) appearing for the respondent has not raised any objection to allow this Criminal Miscellaneous Petition.
5. Considering the submissions made by the learned Counsel for the Petitioner and being satisfied with the reasons stated above, this Court is inclined to modify the Condition No.(ii) in the order made in Crl.MP.No.125 of 2025 dated 15.05.2025 on the file of the learned Vacation Sessions Judge, Nagercoil. Accordingly, Condition No.(ii) is modified as ''(ii). The petitioner shall appear and sign before the respondent police daily at 10.30a.m. until further orders.'' . The other conditions shall remain unaltered.
