PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 and 2 to provide adequate police protection to enable the petitioner to put up an iron gate in the entrance of the petitioners property to an extent of 7.5 cents comprised in Survey No. 362/23 and 362/21 lies as a single plot of Palugal Village (now Malayadi Village), Vilavancode Taluk, Kanyakumari District, by 1/4

virtue of a registered sale deed, dated 30.01.1995, registered at Kunnathukkal Sub Registrar bearing Document No.179/1995 within a stipulated time.

Seeking police protection, the petitioner has approached this Court.

2.Mr.E.Antony Sahaya Prabahar, learned Additional Public Prosecutor takes notice for the respondents 1 & 2 and submits that the petitioner has submitted a representation on 17.07.2025 and the same was enquired by the respondent police in CSR No.278 of 2025 and it was closed, as the issue is civil dispute between the petitioner and the private respondents, by advising the respective parties to approach the competent civil Court, to get the appropriate relief. The petitioner was intimated that for such civil dispute, police protection cannot be granted by the respondent police. 2/4

3.Recording the aforesaid submission of the learned Additional Public Prosecutor, this writ petition is closed, with a direction to the respondent police to furnish a copy of the closure report to this petitioner, enabling him to work out his remedy in the manner known to law. No costs.
