PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Habeas Corpus, to direct the respondents 1 and 2 to produce the body or person of the detenue namely Vasuki, D/o.Murugan aged about 17 years before this Court and hand over her custody to the petitioner.

O R D E R

This Habeus Corpus Petition has been filed to direct the respondents 1 and 2 to produce the body or person of the detenue, the daughter of Murugan aged about 17 years before this Court and hand over her custody to the petitioner.

2. The detenue/daughter of the petitioner born on 16.07.2008 had been produced by the respondent and on request made by Mr.T.Senthil Kumar, learned Additional Public Prosecutor the case had been taken up in the additional list.

3. The girl had expressed her intention to continue with her studies in H.Sc.,(+2) in Government Girls Higher Secondary School, Vadipatti, Madurai District. The parents of the girl are also present. 4.We had an interaction with the child and impressed upon her the necessity to study further and complete her education. We also had an interaction with the petitioner/mother of the detenue who assured 2/5

that she would take care of the child and not abuse or harm her in any manner what so ever.

5. The second respondent/Inspector of Police, Vadipatti Police Station, Madurai District is also present and we have also directed the Inspector of Police to ensure that admission would be obtained in Government Girls Higher Secondary School, Vadipatti, Madurai District for H.Sc.,(+2) for the child.

6. No further orders are required. Accordingly, this Habeas Corpus Petition is closed.
