PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the first respondent to take necessary action for the protection of Aranaiyoor Tank situated in S.No.41/1, Aranaiyoor Village, Ilayankudi Taluk, Sivagangai District and to protect any encroachment under any pretext by taking action against the respondents 4 to 6 and others who are involved in the cutting down of two tamarind trees which were standing in the bund area of the said tank.

ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) With reference to the relief sought for in the present petition the learned Additional Government Pleader appearing for the respondents 1 to 3 based on the written instructions of the Tahsildar, Ilayankudi vide proceedings dated 26.08.2025 would submit that an attempt was made by the private respondents to obstruct the bund, however, the authorities on receipt of an information acted and prevented the illegal actions of the respondents 4 to 6 and the bund is now being 2/4

maintained properly and no obstruction has been caused. It is needless to state that the bund is to be maintained properly by the authorities for the welfare of the people residing in that locality.
