For Respondent : Mr.A.Robinson, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.7 of 2019 on the file of the respondent ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondent.

2. The petitioner apprehending arrest at the hands of the respondent police for the offences under sections 120(b), 498(A), 406 and 506(ii) of I.P.C., in Crime No.7 of 2019, on the file of the respondent police, seeks anticipatory bail.

3.When the petitioner had earlier filed Crl.P.(MD) No.9291 of 2018, FIR was not registered against the petitioner. This Court had imposed a condition that the petitioner should pay a sum of Rs.10,000/- per month as maintenance. Paragraph 2 of the earlier 1/3

order reads as under:- "The de-facto complainant has given a matrimonial complaint against the petitioners. There is a child born through the marriage between the first petitioner and the de-facto complainant. The child is with the de-facto complainant. The marriage had taken place in the year 2010. therefore, the first petitioner / husband undertakes to pay a sum of Rs.10,000/- (Rupees Ten Thousand Only) to the de-facto complainant towards her maintenance and that of the child. This will be only an interim arrangement till the orders passed by the competent Court. The de-facto complainant is directed to furnish the bank details to the first petitioner. This would not prejudice the rights of either parties."

4.The learned counsel appearing for the petitioner submitted that the petitioner is adhering the condition imposed by this Court. 5.Recording the said submission, I am inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.IV, Madurai, and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C scrupulously.

6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
