This Criminal Miscellaneous petition is filed under section 528 of BNSS 2023 to Modify the condition (No.C) imposed upon the petitioner that to direct the petitioner to deposit the Xerox Copy of the Original Registration Certificate of the Petitioners vehicle bearing Registration No.TN-60-AH-4907 before the Learned Judicial Magistrate,Theni instead of depositing the original Registrating Certificate of the petitioner's Vehicle bearing Registration No. TN-60-AH-4907 before the learned Judicial Magistrate, Theni in CRL RC(MD) No.749/2025 dated 06.06.2025.

This Criminal Revision case is filed under Section 438 r/w of BNSS 2023, to call for the records relating to the order dated 06.06.2025 in Crl M.P No. 1667/2025 in Crime No. 103/2025 on the file of the Learned Judicial Magistrate, Theni, and set aside the same and consequentially direct the learned Judicial Magistrate, Theni to return the vehicle Tipper Lorry bearing Registration No.TN-60-AH-4907 to the petitioner.
Order : This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.M.Prabhu, Advocate for the petitioner and of Mr.S.Manoj,Government Advocate (Crl. Side) for the Respondent, the court made the following order:- This petition is filed, seeking to modify the condition No.8(c) imposed by this Court, by order dated 06.06.2025.
2.The learned counsel appearing for the petitioner submitted that the original Registration Certificate has already been deposited before the learned Judicial Magistrate, Aundipatti, in Crime No.116 of 2022 and prayed this Court to modify the aforesaid condition.
3.In view of the above, this Court is inclined to modify the condition No.8(c) alone to the effect that the learned Judicial Magistrate, Theni District, is directed to permit the petitioner to produce the photocopy of the registration certificate along with an affidavit stating that the original registration certificate is already deposited before the aforesaid Court in the said Crime. sd/- Assistant Registrar(CS II) / TRUE COPY / / /2025 Sub-Assistant Registrar (C.S.)
