O R D E R
The present Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the 2nd Respondent to conduct survey and demarcate the petitioner's landed property and to provide police protection in comprised in Survey No.471/1B total extent of 4 cents relating to the petitioner's landed property situated at Nilakottai Village, Nilakottai Taluk, Dindigul District by considering petitioner's representation dated on 14.05.2026.

The petitioner is claiming to survey 4 cents of lands situated in survey No.471/1B and the said property was originally purchased by petitioner's mother through a registered sale deed dated 12.09.1985 vide Document No.2498 of 1985. Thereafter, patta was issued in the name of petitioner's mother in patta No.2296. The petitioner's mother died on 29.06.2006 leaving behind the legal heirs namely, the petitioner Veerarajan, Singaravelan and Chitra. The legal heirs have entered into a registered partition deed dated 25.08.2011 vide Document No.146 of 2012. The petitioner was allotted the property in dispute situated in Survey No.471/1B. The adjacent land owner, who is the 4th respondent herein encroaching the petitioner's land and trying to put up construction. Hence, the petitioner is seeking to survey and demarcate the property in dispute.
3. In fact, the petitioner further submitted that already the survey was conducted, but the 4th respondent is not allowing to conduct the survey properly. Therefore, the petitioner is seeking to survey in the presence of the head surveyor and with the help of police. Page No. 3 of 6

Therefore, the first respondent/Tahsildar is directed to consider the petitioner's representation dated 14.05.2026 and survey the property with the assistance of the Surveyors, namely, the second respondent herein, after issuing notice to the petitioner, the 4th respondent and the rival parties, if any, in accordance with law. In case the first respondent/Tahsildar seeks police protection for carrying out the survey, the third respondent shall provide the necessary police protection. The respondents 1 to 3 shall adhere to the following Standard Operating Procedures:
• The respondents shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. The petitioner shall affix the signature by receiving the notice of survey.
• After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction. • If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest.

The aforesaid procedure shall be strictly followed by the parties. The said exercise shall be completed within a period of twelve (12) weeks from the date of receipt of a copy of this order.
5. With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
