ORDER

Seeking to direct the respondents to consider the petitioner's complaint dated 25.05.2026 and direct them to conduct fair and impartial enquiry, this writ petition is filed.

2. The learned counsel for the petitioner submitted that the petitioner has lodged a complaint as against her husband with the 2nd respondent police. However, having not initiating any action against her husband, the 2nd respondent police had indulged in intimidating the petitioner and compelled her to give an written undertaking that she herself is voluntarily withdrawing the complaint. Pursuant to which, the petitioner had sent a representation to the Chief Minister's Cell about the atrocious manner in which the 2nd respondent had conducted enquiry and compelled her to withdraw the complaint against her husband. Since there is no action, the petitioner is before this Court.

3. Heard the learned counsel on either side and carefully perused the materials available on record.

4. In this regard, The Deputy Superintendent of police, Theni District, Theni is suo motu impleaded as 4th respondent. Registry is directed to carry out the necessary amendment in the cause title.

5. The 4th respondent is directed to transfer the investigation from the file of the 2nd respondent to some other competent Inspector of Police. Upon such transfer, the newly appointed Investigating Officer shall take over the investigation and conclude the same as expeditiously as possible within a period of four (4) weeks from the date of transfer of investigation.
