Respondents [4th respondent is suo motu impleaded vide order of this Court dated 17.07.2025] PRAYER : Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of MANDAMUS to direct the 3rd respondent to defreeze the petitioner's family property in Survey Nos. 139/3 and 139/4 (renumbered as S.Nos.139/4A1B and 139/4B) situated at Keelakarai Village, Keelakarai Group, Keelakarai Taluk, Ramanathapuram District and consequently direct the 3rd respondent permit the petitioner to register the sale deed in the above said property and release the same within the time stipulated by this Court. 1/4

ORDER
The present Writ Petition has been filed for the issuance of a Writ of Mandamus, directing the 3rd respondent to defreeze the petitioner's family property and consequently direct the 3rd respondent to permit the petitioner to register the sale deed in the above said property and release the same within the time stipulated by this Court.
2. Since the the Revenue Divisional Officer, Ramanathapuram District is a necessary party in the present writ petition, this Court suo motu impleaded as 4th respondent.
3. On instructions, the learned Government Advocate appearing for the respondents submitted that the District Registrar has forwarded a communication dated 27.05.2024, directing the revenue authorities to state whether there is any order regarding S. Nos.139/3 and 139/4. In response, the District Collector, through a communication dated 05.07.2024, directed the Revenue Divisional Officer to conduct an enquiry. 2/4
4. Accordingly, the Revenue Divisional Officer, Ramanathapuram, is directed to conduct an enquiry after issuing notice to the aggrieved parties and submit a report to the District Collector, Ramanathapuram District. In turn, the District Collector shall forward the same to the 3rd respondent. The 3rd respondent shall then take appropriate action, consider the petitioner's claim, and intimate the decision to the petitioner. The entire exercise shall be completed within a period of three months from the date of receipt of a copy of this order.
5. With these directions and observations, this writ petition is allowed. No Costs.
