For Respondent : Mr.M.Veeranthiran, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :-For Anticipatory Bail in Crime No.87 of 2022 on the file of the respondent Police.
ORDER : The Court made the following order :- The petitioner/A5, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 147, 148, 294(b), 342, 307 and 506(ii) IPC in Crime No.87 of 2022 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that A1 and A2 had quarrelled with the de-facto complainant demanding liquor in the TASMAC shop after the closing hours. In that quarrel, A1 and A2 attacked the de-facto complainant and his friend Pandiyarajan by using deadly weapons. Thereafter, the petitioner came in a bike and picked up A1 and A3. Further, all the accused abused the de-facto complainant in filthy language. Hence, the complaint.
3.The learned counsel for the petitioner would submit that the petitioner is innocent and there is no overt act attributed against the petitioner and he is a friend of A1. Hence, he prays for anticipatory bail.

CRL OP(MD). No.15700 of 2022 4.The learned Government Advocate (Crl. side) would submit that the de-facto complainant was discharged from the hospital and his friend Pandiyarajan is still taking treatment in the hospital. Hence, he strongly opposed to grant anticipatory bail. 5.Considering the gravity and nature of the offence and also considering the fact that the de-facto complainant's friend is still in hospital, this Court is not inclined to grant anticipatory bail to the petitioner.
