PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to direct the Prl.Dist and Sess.Judge, Thoothukudi to dispose the application Cr.MP No.3189 of 2019 pending on the file of the Prl.Dist and Sess.Judge, Thoothukudi within a specified time as may be fixed by this Hon`ble Court. .

ORDER

This petition has been filed seeking direction to direct the learned Principal District and Sessions Judge, Thoothukudi to dispose the application in Cr.MP No.3189 of 2019 pending on the file of the learned Principal District and Sessions Judge, Thoothukudi.

2. Today when the matter is taken up for hearing the Government Advocate (Crl.Side) would submit that the case has been registered in Crime No.83 of 2019 for the offences under Sections 379 of IPC. Now petition for return of vehicle under Section 451 and 457 of Cr.P.C was filed by the petitioner before the learned Principal District and Sessions Judge, Thoothukudi and it is pending.

3. Hence there shall be direction to the learned Principal District and Sessions Judge, Thoothukudi to consider the petition filed by the petitioner for return of vehicle on merits and in accordance with law within a period of four weeks from the date of receipt of a copy of this order.
