O R D E R
This writ petitioner is filed for issuance of writ of mandamus directing the respondents to remove the petitioner's name from the Rowdy list History Sheet in H.S.No.527 of 2020 pending on the file of the third respondent police station considering the petitioner's representation dated 05.10.2021.
2.The case of the petitioner is that he is a building contractor by profession and because of his alleged involvement in criminal cases, History Sheet has been oped in H.S.No.527 of 2020. Thereafter, the petitioner has filed Crl.O.P(MD)No.949 of 20201 to quash the case in Crime No.681 of 2020 and the same was quashed by this Court. After quashing of the above said case, only one case in Crime No.509 of 2020 for the offences under Sections 188, 270 IPC and Section 12 of TNG Act is pending. According to the petitioner, the respondents failed to review H.S.No.527 of 2020 since only one https://hcservices.ecourts.gov.in/hcservices/ 1/2
W.P.(MD) No.19213 of 2021 case is pending against the petitioner. Therefore, the petitioner sent a representation dated 05.10.2021 to remove his name from the rowdy list and since no action has been taken on his representation, the petitioner is before this Court.
3.The learned Additional Public Prosecutor would submit that 5 cases were pending against the petitioner and now, 3 cases have been closed and 2 cases are pending and only because of that, History Sheet has been opened against the petitioner. 4.Since representation has been kept pending, there will be a direction to the first respondent to consider the representation of the petitioner on merits and dispose of the same within a period of 4 months from the date of receipt of a copy of this order. 5.With the above direction, this petition is disposed of. No costs.
