To direct the Special Court for SC and ST (POA) Act Cases, Srivilliputhur, Virudhunagar District to consider the petitioners bail application on the day of surrender in Crime No.209/2023 on the file of the Deputy Superintendent of Police, Sivakasi Sub Division, Virudhunagar District for offence under section 294(b), 506(1) IPC r/w. Section 4 of TNPHW Act and Section 3(1)(s), 3(2)(va) SC/ST(POA) Act, 1989.
Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S. RAMASAMY.S, Advocate for the petitioner and of M/S.SS.MADHAVAN, Government Advocate (Crl.side) on behalf of the Respondents 1 & 2, the court made the following order:- This petition is filed seeking to extend the time for surrender before the learned Principal District and Sessions Judge, Virudhunagar District, Srivilliputhur (Special Case for SC/ST Act Cases) as per the order of this Court in Crl.O.P.(MD).No.10267 of 2023.
2. It is submitted that though this Court has granted relief sought for by the petitioner in Crl.O.P.(MD).No.10267 of 2023 on account of not getting leave from the 2/4
employer where he is working he could not surrender before the Court and file this application.
3. Considering the same, time is granted as per the orders Crl.O.P.(MD). No.10267 of 2023 are extended until 11.08.2023. The other conditions remain unaltered.
