PRAYER :- Writ Petition is filed under Article 226 of the Constitution of India for issuance of a Writ of mandamus calling for the records pertaining to the order passed by the 6th respondent in his proceedings in O.Mu.No.2416 / A3 / 2017, dated 23/03/2017 and quash the same and consequent direction may be issued to the respondents to upgrade panchayat Union Middle School, Karsery as Government High School. ORDER

[Order of the Court was made by The Hon'ble The CHIEF JUSTICE] Heard the learned counsel for the petitioner and the learned Government Pleader for the respondents.

2.The learned counsel for the petitioner submits that there is no High School in the village. School is only from 1st to 8th standards. There are about 128 students. There is a need for High School upto 10th standard.

3.The learned Government Pleader submits that there are only 52 students in the said school. In 8th standard, there are only 17 students. 2/5

The Government High School is situated at a distance of 3 kms.

4. The necessary strength of students is required to be available for opening a High School. The nearest school is 3 kms. away. No doubt, for the sake of students, the Government is bound to open High Schools. In case, in future, the strength increases, then, the respondents may certainly consider the grievance of the petitioner for opening up of a High School.

The writ petition stands disposed of. However, there shall be no order as to costs. Consequently connected Miscellaneous Petition is closed.
