Side) PRAYER :- This Criminal Miscellaneous Petition is filed under Section 439(i)(b) of Cr.P.C./483(i)(b) of BNS to modify the order dated 08.06.2026 made in Crl.M.P.No.932 of 2026 on the file of the Principal Sessions Judge, Theni District, insofar as the condition that the petitioners shall appear and sign before the respondent police station daily at 10.00 a.m. and 05.00 p.m. as to report before the respondent police station once in a week at 10.30 a.m. until further orders.

ORDER

This petition has been filed to modify the order dated 08.06.2026 made in Crl.M.P.No.932 of 2026 on the file of the Principal Sessions Judge, Theni District, insofar as the condition that the petitioners shall appear and sign before the respondent police station daily at 10.00 a.m. and 05.00 p.m. as to report before the respondent police station once in a week at 10.30 a.m. until further orders.

2.The learned counsel for the petitioner would submit that the first petitioner is working as Revenue Inspector and the second petitioner is a student, studying in College. Hence, both petitioners may be permitted to appear before the respondent once in a week.

3.The learned Government Advocate (Crl. Side) would submit that the petitioners have not complied the condition even for a single day. 4.Considering the reasons stated by the learned counsel for the petitioners, that the first petitioner is working as Revenue Inspector and the second petitioner is the student, this Court is inclined to modify the condition imposed by the trial Court to the effect that "the petitioners shall appear before the respondent police at 10.30 a.m., on every Saturday and Sunday for a period of two weeks, thereafter as and when required for interrogation." The other conditions imposed by the trial Court shall remain unchanged. 2/4

5.With the above said modifications, this criminal original petition stands disposed of.
