(Crime No.125/2020) PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying this Court to directing the second respondent to withdraw the case in Crime No.125/2020, dated 13.11.2020, under Sections 279 and 304(A) of IPC on the file of the fourth respondent and entrust the same to the third respondent for an investigation of the case by a competent officer or any other independent investigating agency and file a final report before the jurisdictional Magistrate within the time stipulated by this Court.

ORDER

The criminal original petition has been filed seeking a direction to the second respondent to withdraw the case in Crime No.125/2020, dated 13.11.2020, under Sections 279 and 304(A) of IPC on the file of the fourth respondent and entrust the same to the third respondent for an investigation and file a final report before the jurisdictional Magistrate within the time stipulated by this Court.

2.The learned Government Advocate (Crl.Side) would submit that the respondent police had filed negative final report before the learned Judicial Magistrate No.I, Ramnad and RCS notice was also served on the petitioner.

3.Therefore, there is no investigation pending on the file of the fourth respondent. The criminal original petition is dismissed. Consequently, the connected miscellaneous petition is also closed.
