For Respondent : Mr.R.Erottuchamy, Government Advocate (Criminal Side) PETITION FOR ANTICIPATORY BAIL Under Section 438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.319 of 2020 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/sole accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 379 IPC r/w. Section 21(iv)of Mines and Minerals(Development and Regulation) Act, seeks anticipatory bail.
2.The case of the prosecution is that when the defacto complainant and other officials were under surveillance, the petitioner found to be stealing 1⁄2 Unit of river sand by using Tractor.
3.In view of the order passed in Crl.O.P.No.13334 of 2020 etc., batch, dated 03.09.2020 by the Principal Bench of this Court at Madras, this Court is not inclined to grant anticipatory bail to the petitioner.
