O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first and second respondents herein to consider the petitioner's representation dated 24.05.2023 and to remove the names of the third to sixth respondents herein from Patta Nos.1164 and 6306 with regard to the property in Survey Nos.404/1 and 406, situated at R.Kombai Village, Gujiliamparai Taluk, Dindigul District.

2. The case of the petitioner is that the subject property belongs to the petitioner by virtue of a settlement deed executed by the petitioner's father. The said property was previously mortgaged with one Gurusamy Chettiar. Since the petitioner's father and his brothers, namely late Palanivel and the sixth respondent herein, could not redeem the property, the petitioner redeemed the same.

Though the third to fifth respondents, who are the legal heirs of late Palanivel, and the sixth respondent have no right over the property, they approached the second respondent for inclusion of their names in the patta. Pursuant to the same, the second respondent, without conducting any enquiry, included their names in the patta.

4. Therefore, the petitioner submitted a representation dated 24.05.2023 to the first and second respondents seeking removal of their names from the patta. However, no action has been taken on the petitioner's representation. Hence, the petitioner was constrained to file the present Writ Petition.

5. The learned Government Advocate appearing for the first and second respondents would submit that the petitioner's representation dated 24.05.2023 would be considered and appropriate orders would be passed by the first respondent within a period of twelve weeks.

6. Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the first respondent to consider the petitioner's representation Page No. 3 of 5

dated 24.05.2023 on its merits and in accordance with law and pass appropriate orders within a period of twelve weeks from the date of receipt of a copy of this order. The representation dated 24.05.2023 shall be considered and disposed of after conducting an enquiry. The first respondent is also directed to provide a reasonable opportunity during such enquiry to the petitioner, the private respondents and any other interested parties who may be affected by the decision. In the event of any rival claims, the parties are at liberty to pursue their remedies before the Civil Court. There shall be no order as to costs.
