Heard Mr.R.Sundar Srinivasan, learned counsel appearing for the petitioner and Mr.J.Jeyakumaran, learned counsel for the respondents.

2.The revision petitioners are the defendants in the suit and the respondent/plaintiff has filed a suit in O.S.No.47 of 2017 before the District Munsif, Lalgudi, for perpetual injunction. Thereafter, in the said suit, the revision petitioners/defendants filed an application in I.A.No.42 of 2018 seeking to appoint an Advocate Commissioner. The said I.A was dismissed. Challenging the order of dismissal of I.A., the defendants have filed the present civil revision petition. When the matter is taken up for hearing today, the learned counsel for the petitioner submitted that during the pendency of the civil revision petition, the said suit was https://hcservices.ecourts.gov.in/hcservices/ 1/2

C.R.P(PD)(MD)No.858 of 2018 dismissed on 06.02.2020. Hence, nothing survives for adjudication in this matter.

3.In view of the submission made by the learned counsel for the petitioner, this Civil Revision Petition is dismissed as infructuous. No costs. Consequently, connected miscellaneous petition is closed.
