ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl. Side) appearing for the respondent.
2. The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under sections 8(c) r/w. 20(b), (ii) (b) of NDPS Act, in Crime No.1684 of 2020 on the file of the respondent police, seeks anticipatory bail.
3. On reading of the FIR shows that the petitioners along with others were found in possession of contraband and preparing package for sale. The petitioner ranaway from the place of occurrence when the officials approached them. CRL OP(MD). No.16056 of 2020 only on the confession statement of the Co-accused, the petitioner was arrayed as accused. But the FIR shows that the petitioner was also present in the scene of occurrence and ranaway, on seeing the officials.
4.Since prima facie materials are available against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
