ORDER

The petitioner, who is the defacto complainant in Cr.No.257 of 2024 on the file of the second respondent Police, has filed this petition seeking a direction to the second respondent Police to complete the investigation in the said case and file a final report, within a time frame. 2.The learned Government Advocate(Crl.side) appearing for the respondents submits that the investigation in this case was completed and the case was closed as 'Mistake of Fact', on 08.11.2024 itself and RCS notice has also been served on the petitioner. However, suppressing the same, the petitioner has filed the present petition. 3.The learned counsel appearing for the petitioner submits that the petitioner has not been served with any RCS notice. 4.Since the case itself was closed as 'Mistake of Fact', this Court is not inclined to entertain this petition. The petitioner is at liberty to challenge the final report, provided if he is having any grounds and the 2/4

learned Judicial Magistrate, Orathanadu shall entertain the protest petition, if the petitioner has not been served with RCS notice. In the event, if the petitioner has received and signed in the RCS notice, the learned Judicial Magistrate, Orathanadu need not entertain the protest petition.
