COMMON PRAYER: Writ Petitions filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the second respondent to re-fix the scale of pay of the petitioners at Rs.2000-3500 on par with the scale of pay sanctioned to similarly placed vocational instructors by extending the benefit of Government Order in G.O.(1D) No.327, Education Department, dated 18.11.2013 along with consequential monetary benefits to the petitioners for the service rendered in the post of Vocational Instructor within the time period stipulated by this Court.
For Petitioner : Mr.T.Lajapathi Roy (in both Writ Petitions) For Respondents : Mr.M.Karuppasamy, (in both Writ Petitions) Government Advocate. COMMON ORDER Since the issues involved in these Writ Petitions are one and the same, these Writ Petitions are heard together and disposed of by way of this common order.
2.Heard Mr.T.Lajapathi Roy, learned counsel appearing on behalf of the petitioners and Mr.M.Karuppasamy, learned Government Advocate, who takes notice on behalf of the respondents. 1/3
3.By consent of both parties, these Writ Petitions are taken up for final disposal at the stage of admission itself. 4.These Writ Petitions are filed for a direction to the second respondent to re-fix the scale of pay of the petitioners at Rs.2000-3500 on par with the scale of pay sanctioned to similarly placed vocational instructors by extending the benefit of Government Order in G.O.(1D) No.327, Education Department, dated 18.11.2013 along with consequential monetary benefits to the petitioners for the service rendered in the post of Vocational Instructor. 5.The petitioners were working as Vocational Instructor and retired from service on 31.01.2017, on attaining the age of superannuation.
According to the learned counsel for the petitioners, the petitioners are possessing M.Com., M.Phil and M.Ed., As per G.O.(1D)No.327, Education Department, dated 18.11.2013, they are entitled for the scale of pay of Rs.2000-3500. The similarly placed persons filed a number of Writ Petitions and this Court granted the benefits.
The petitioners made representations, dated 19.08.2019. However, no order is passed thereon. Hence, the petitioners have come out with the present Writ Petitions.
6.Considering the relief sought for in the present Writ Petitions by the petitioners, these Writ Petitions are disposed of, directing the respondents to consider the representations of the petitioner, dated 19.08.2019, as per G.O.(1D) No.327, Education Department, dated 18.11.2013 and pass orders on merits and in accordance with law, as expeditiously as possible.
