ORDER

This writ petition has been filed for a writ of Mandamus to direct the second respondent to take immediate action based on the petitioner's representation dated 16.06.2025.

2. This writ petition is disposed of at the time of admission after dispensing with notice to the fourth respondent as no adverse orders are proposed to passed against her.

3. The petitioner claims to be the Manager of Thanekoneriappa Mudaliar Kattalai, Thiruvavadurdurai Aadhinam. The petitioner has submitted a representation to the second respondent seeking to take steps to evict the fourth respondent, who has purportedly encroached on the property of the aforesaid Aadhinam, of which the petitioner is the Manager. 2/5

4. It is submitted that the petitioner will have to file an appropriate application under Section 78 of the Tamil Nadu Hindu Religious and Charitable Endowments Act, 1959, although the petitioner may have a case for directing the official respondents to evict the fourth respondent.

5. Under these circumstances, liberty is granted to the petitioner to file an appropriate application under Section 78 of the Tamil Nadu Hindu Religious and Charitable Endowments Act, 1959 before the third respondent. The third respondent shall thereafter consider the application and pass appropriate orders on merits and in accordance with law, after giving due notice to the fourth respondent.
