For Respondent : Mr.S.S.Madhavan Government Advocate (Crl. side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :-For Anticipatory Bail in Crime No.631 of 2021 on the file of the Respondent police.

ORDER : The Court made the following order :- The petitioner/A6, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 294(b), 323, 506(i) and 306 of IPC in Crime No.631 of 2021 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner and other accused have assaulted the deceased Prabhakaran/ son of the defacto complainant and criminally intimidated him to return back the laptop and mobile phone which was stolen. Due to the threat made by the accused persons, the son of the defacto complainant had consumed poison and died. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case, since he is the friend of the other accused. However, he had not assaulted the son of the defacto complainant. https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.16341 of 2021 4.The learned Government Advocate (Crl. side) appearing for the respondent police would submit that the accused Nos.1,3 and 4 are still in judicial custody. However he opposed to grant anticipatory bail to the petitioner.

5.Considering the seriousness and gravity of the alleged offence and also the fact that the investigation is pending as stated by the learned Government Advocate (Criminal Side), this Court is not inclined to grant anticipatory bail to the petitioner. 6.Accordingly, this Criminal Original Petition is dismissed. sd/- 23/11/2021 / TRUE COPY / / /2021 Sub-Assistant Registrar (C.S.)
