Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.C.SENTHIL MURUGAN, Advocate for the petitioner and of Mr.P.KOTTAI CHAMY, Government Advocate(crl.side) on behalf of the Respondent, the court made the following order:- This petition has been filed by the petitioner seeking to modify the condition imposed by this Court in Crl.O.P.(MD)No.15055 of 2021 vide order dated 08.10.2021.

2. This Court, vide order dated 08.10.2021, in Crl.O.P.(MD) No.15055 of 2021, granted bail to the petitioner on condition that the petitioner shall execute a bond for a sum of Rs.1,00,000/- with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Pappanasam and the persons who are giving sureties should be respectable persons in their locality, either Government Servants or elected people representatives or the persons who are having permanent business establishments.

3. The learned counsel appearing for the petitioner submits that since the petitioner is not in a position to arrange sureties as directed by this Court, he is languishing in jail for the past 120 days. He further submits that the petitioner's uncle, who is https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL MP(MD) No.8971 of 2021 running a shop, is ready to stand as surety for the petitioner. Therefore, he requests this Court to modify the said condition.

4. Considering the submissions made by the learned counsel for the petitioner and also considering the fact that the petitioner's uncle, who is running a shop, is ready to stand as surety for the petitioner, the condition is modified to the effect that the petitioner's uncle shall furnish surety for a sum of Rs.1,00,000/- for the petitioner and any other person shall furnish surety for a sum of Rs.25,000/- for the petitioner to the satisfaction of the learned Judicial Magistrate, Pappanasam. Time already granted by this Court to execute the sureties is extended by ten days from the date of receipt of a copy of this order.

5. Accordingly, this petition is ordered.
