Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the first respondent to issue a passport to the Petitioner based on his application No.MD1075096154725 dated 28.05.2025 within the time stipulated by this Court.

ORDER

This writ petition has been filed for a Mandamus to direct the first respondent to issue a passport to the Petitioner based on his application No.MD1075096154725 dated 28.05.2025.

2. The petitioner has been arrayed as an accused in three different FIRs registered against him.

The learned Government Advocate for the second respondent submits that as far as FIR registered in Crime No.56 of 2017 filed before the All Women Police Station, Melur is concerned, the petitioner has obtained a favourable order from this Court in Crl.OP(MD)No.7499 of 2025. Accordingly, the FIR filed against the petitioner stands quashed.

4. As far as FIR in Crime No.726 of 2021 is concerned, a charge sheet was filed against the petitioner in S.T.C.No.145 of 2022 in which the petitioner suffers the punishment and also paid the fine. 2/5

5. That apart, as far as the FIR registered in Crime No.17 of 2016 is concerned, the learned Government Advocate for the second respondent submits that case is still under investigation and no charge sheet has been filed.

6. Considering the above, there can be no impediment in directing the first respondent to process the passport's application filed by the petitioner on 28.05.2025.

7. Therefore, the first respondent is directed to process the petitioner's passport application, dated 28.05.2025 and issue passport to the petitioner within a period of 6 weeks from the date of receipt of a copy of this order.. The petitioner shall surrender the passport before the concerned Court in case a charge sheet is filed against the petitioner in furtherance of FIR registered in Crime No. 17 of 2016. If the petitioner fails to comply with the above condition, the first respondent is at liberty to cancel the passport. 3/5
