O R D E R

The present Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondent 1 and 2 to conduct land survey and fix survey stone and thereby demarcating Petitioner Coffee Plantation Land in Survey No.230/2 to the extent of 06 Acers and 20 cent -Situated at Bodi Merukumalai Village, Bodinayakanur Taluk, Theni District by considering the petitioner's written representation dated 28.05.2026.

The petitioner Ramaraj along with one Jevitha had purchased the land in Survey No.230/2 to an extent of 06 acres and 20 cents through a registered sale deed dated 06.10.2025, in Document No.6046 of 2025. Subsequent to the sale, revenue records were mutated and separate patta was issued in the name of the petitioner and Jevitha in Patta No.2832. Based on the above facts, the petitioner is seeking to survey and to demarcate the property and therefore, the Tahsildar may be directed to survey after issuing notice to the respondents 4 to 6 who are the adjacent landowners disputing the boundaries.

3. Heard the learned counsel on either side.

Therefore, the first respondent/Tahsildar is directed to consider the petitioner's written representation dated 28.05.2026 and survey the property with the assistance of the Surveyor, namely, the second respondent herein, after issuing notice to the petitioner, the respondents 4 to 6, the other pattadars and the rival parties, if any, in accordance with law. In case the first respondent/Tahsildar seeks police protection for carrying out the survey, the third respondent shall provide the necessary police protection. The respondents shall adhere to the Page No. 3 of 6

following Standard Operating Procedures:

• The respondents shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. The petitioner shall affix the signature by receiving the notice of survey.

• After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction. • If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest.

The aforesaid procedure shall be strictly followed by the parties. The said exercise shall be completed within a period of twelve (12) weeks from the date of receipt of a copy of this order.

5. With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
