Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned seniority list dated 22.02.2021 on the file of the third respondent and quash the same as illegal insofar as not including the petitioner is concerned and consequently for a direction, directing the third 1/4

respondent to include the petitioner by considering the date of initial appointment of the petitioner with effect from 05.09.2005 and on the basis of the rank secured by the petitioner in the recruitment conducted by Teachers Recruitment Board within the time stipulated by this Court. ORDER

Though the petitioner herein has challenged the seniority list on the ground of non-inclusion of his name as illegal, the learned counsel for the petitioner submitted that the petitioner will be satisfied if her representation, dated 22.08.2022 in this regard is directed to be considered by the respondents. 2.In the light of the submission made, this Court is of the view that such a direction would be given to the third respondent herein. Accordingly, there shall be a direction to the third respondent to consider the petitioner's representation, dated 22.08.2022, on its own merits and pass appropriate orders in accordance with law, within a period of eight (8) weeks from the date of receipt of a copy of this order. It is made clear that this Court has not expressed 2/4

any of its views with regard to the merits of the claim of the petitioner and that it is open to the concerned respondent to consider the same on its own merits. 3.In view of the above direction, this Writ Petition stands disposed of.
