ORDER

This Writ Petition is filed to quash the impugned Refusal Check Slip dated 04.07.2025 and consequently direct the 2nd Respondent to register the sale deed presented by the petitioner.

2. Through the impugned order the respondents stated that the petitioner has not obtained approval for the lay out, which is against Section 22(A) of the Registration Act. The petitioner has inherited the property through a partition deed dated 12.05.2022. On perusing the partition deed, particularly the four boundaries, it is seen that a 6-feet-wide road running from south to north already exists on the eastern side. The petitioner now intends to sell the same. Since this is not a newly formed layout and not a newly formed road, the issuance of the impugned check slip by the official respondents reflects non-application of mind.

3. Accordingly, the impugned refusal check slip dated 04.07.2025 is hereby quashed. The 2nd respondent is directed to register the sale deed within a period of four weeks from the date of receipt of a copy of the order. 2/4

4. With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
