PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the respondents Nos.1 & 2 to provide adequate police protection to the petitioner life and limb by considering the petitioner's representation dated 15.07.2023.

O R D E R

This Criminal Original Petition is filed seeking for a direction to the respondent police to provide sufficient police protection to the life of the petitioner on account of threatening of the third respondent.

2. It is submitted by the learned counsel for the petitioner that the petitioner has purchased the property from the father of the third respondent in the year 2021 and subsequently, the petitioner intend to construct the building over the said property, however, the third respondent along with henchman tried to obstruct the construction. Accordingly, the petitioner's son has filed the complaint before the respondent police on 25.05.2023 and no action has been taken.

3. It is further submitted that on the instigation of the third respondent, the Village Administrative Officer has issued a notice that the construction being undertaken by the petitioner is not in accordance with the permission granted. It is also further submitted that the petitioner has been constructing the building as per the approval plan only, however, the third respondent is threatening with dire consequences. Accordingly, the petitioner has filed a complaint, therefore, sought for suitable direction. 2/5

The learned Government Advocate (Crl.side) appearing for the respondents 1 & 2 on the other hand submitted that the complaint given by the petitioner was registered in C.S.R.No.1012 of 2023 and enquiry has been initiated and summon has been issued to appear before the respondent police on 04.08.2023.

5. Since the complaint of the petitioner has taken cognizance by the respondent police and enquiry is being proceeded, the respondent police are directed to complete the enquiry as quickly as possible, not later than two weeks from the date of receipt of a copy of this order.
