Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the first respondent to reissue/renew petitioner's Passport in PssportNo.M6147464 pursuant to his renewal application in Application Reference Number (ARN) No. 25-1003695047 pending before the first respondent within a stipulated time that may be fixed by this Court.

ORDER

This writ petition has been filed for a Mandamus to direct the first respondent to reissue/renew petitioner's Passport in PssportNo.M6147464 pursuant to his renewal application in Application Reference Number (ARN) No.25-1003695047 pending before the first respondent.

2. The learned Government Advocate for the second respondent submits that the petitioner has been arrayed as Accused No.1 in Crime No.204 of 2015 for offences under Sections 294(b), 324 and 506 (ii) of the IPC. He further submits that the case is still under investigation and no charge sheet has been filed against the petitioner till date.

3. Considering the fact that no case is pending against the petitioner before any criminal Court, there can be no impediment for renewal of passport of the petitioner.

Under these circumstances, there shall be a direction to the first respondent to renew the passport application of the petitioner as expeditiously as possible preferably within a period of 8 weeks from the date of receipt of a copy of this order. In case charge sheet is filed, the petitioner shall surrender the passport before the concerned court and thereafter retrieve the same as and when the petitioner proposes to travel abroad by filing appropriate application.
