PRAYER: This Transfer Civil Miscellaneous Petition filed under Section 24 of the Civil Procedure Code, to withdraw the case in HMOP.No.1799 of 2021 from the file of the Sub-Court, Alandur, Chennai and to transfer the said case to the Principal Sub-Court, Dindigul.

O R D E R

This petition is filed to withdraw the case in H.M.O.P.No.1799 of 2021 from the file of the Sub-Court, Alandur, Chennai and to transfer the said case to the Principal Sub-Court, Dindigul. 2.The learned counsel for the petitioner submitted that H.M.O.P.No.1799 of 2021 was filed by the respondent/husband, for divorce before the Subordinate Court, Alandur, Chennai. He further submitted that since the petitioner is residing at Canda, her parents are contesting the case, they are not able to travel from Dindigul to Chennai. Hence, she seeks transfer of the case. 3.I have considered the rival submissions made by the learned counsel for the petitioner and perused the materials placed before this Court. Since the petitioner/wife is residing at Canada, her parents are contesting the case. This Court has not satisfied with the reasons stated in the affidavit. Since the petitioner is in Canada, she can appear through video conference after getting permission from the trial Court.

4.In view of above, this Transfer Civil Miscellaneous Petition is dismissed. Since H.M.O.P.No.1799 of 2021 is pending before the Subordinate Court, Alandur, Chennai, the appearance of the https://hcservices.ecourts.gov.in/hcservices/ 1/2

Tr.C.M.P(MD).No.470 of 2021 petitioner is dispensed with and the petitioner is permitted to appear through her counsel. No costs. Consequently connected miscellaneous petition is closed.
