The Civil Miscellaneous Petition has been filed seeking orders to condone the delay of 32 days in filing the appal against the judgment and decree, dated 26.02.2024 in A.S.No.123 of 2018 on the file of the Additional District and Sessions Court, Palani, reversing the judgment and decree, dated 27.06.2018 in O.S.No.246 of 2008 on the file of the Sub Court, Palani.
2. When the matter is taken up for hearing today, the learned counsel appearing for the petitioner has filed a memo stating that the fourth respondent/Chinnammal died and her legal heir one Periyasamy had already predeceased and the legal heirs of Periyasamy are already on record.
3. The said memo is recorded. Heard the learned counsel for the petitioners, learned counsel for the respondents and also perused the records. 4.The learned counsel appearing for the respondents would submit that they are having objections to condone the delay, but they have not specified any objections. 1/2 https://www.mhc.tn.gov.in/judis

5. Considering the reasons assigned and also taking note of the quantum of delay, this Court is inclined to condone the delay. Accordingly, this petition is ordered and the Registry is directed to take the appeal on file, if it is otherwise in order and list the matter in the usual course.
