ORDER

The petitioner herein seeks a direction to the second respondent to consider the appeal preferred by the petitioner dated 12.01.2024 seeking cancellation of patta issued in favour of the fourth respondent in so far as excess extent of 18 cents comprised in Survey No.86/1 in Puthur Village, Palani Taluk, Dindigul District.

2. Heard the arguments of Mr.T.Lenin Kumar, learned counsel appearing for the petitioner and Mr.A.Baskaran, learned Additional Government Pleader, who takes notice for the respondents 1 to 3. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

It is not in dispute that the petitioner preferred an appeal before the second respondent on 12.01.2024 seeking cancellation of patta issued in favour of the fourth respondent in respect of excess extent. Pursuant to the said appeal preferred by the petitioner, the second respondent in his proceedings Na.Ka.No.820/24/A1 dated 17.05.2024 directed the third respondent to submit a report. Thereafter, there was no progress. Hence, the petitioner has come before this Court.

4. The learned Additional Government Pleader appearing for the respondents 1 to 3 would submit that the appeal preferred by the petitioner will be considered in accordance with law within the time stipulated by this Court.

5. In view of the same, without expressing any opinion on the merits of the matter, the second respondent is directed to consider the appeal preferred by the petitioner dated 12.01.2024 and pass final orders on its own merits within a period of 12 weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner and the respondents 4 and 5.

6. With the above direction, this Writ Petition stands disposed of. No costs.
