Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the first respondent to consider the petitioner's application in MD1075096455925 dated 20.05.2025 to re-issue the Passport to him.

ORDER

This writ petition has been filed for a writ of Mandamus to direct the first respondent to consider the petitioner's application in MD1075096455925 dated 20.05.2025 to re-issue the passport to him.

2. The learned Government Advocate for the second respondent submits that the petitioner was an accused person in Crime No.175 of 2016 for offences under Section 341, 294(b) of the IPC. He further submits that a charge sheet was filed, pursuant to which the case was taken on file as S.T.C.No.79 of 2016 before the Judicial Magistrate VI, Madurai. It is also submitted that the petitioner was discharged from the said case on 19.10.2019.

The leanred Government Advocate for the second respondent further submitted that the petitioner is also arrayed as an accused in Crime No.669 of 2017 for offences under Sections 448, 427 and 506(1) of the IPC. It is submitted that the case is still under investigation and no charge sheet has been filed till date.

4. Considering the fact that no criminal case is pending against the petitioner before any Court, there can be no impediment for renewal of passport of the petitioner.

Under these circumstances, there shall be a direction to the first respondent to renew the passport application of the petitioner as expeditiously as possible preferably within a period of 6 weeks from the date of receipt of a copy of this order. In case charge sheet is filed in respect of Crime No.669 pf 2017, the petitioner shall surrender the passport before the concerned court and thereafter, retrieve the same as and when the petitioner proposes to travel abroad by filing appropriate application.
