Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for the entire records in relating to the impugned order in Letter Ref.No. OBJ/1049474828/25 dated 01.07.2025 of the first respondent and to quash the same as illegal and consequent direction to the first respondent to reissue/renew the passport of the petitioner for the period of 10 years on the basis of petitioner passport application taken on the file as File No. TR1075132834525 dated 04.06.2025 within the time stipulated by this Court.

ORDER
This writ petition has been filed challenging the order dated 01.07.2025 passed by the first respondent and consequently directing the first respondent to re-issue/renew the passport of the petitioner on the basis of petitioner passport application dated 04.06.2025.
2.The petitioner is the sole accused in the FIR registered in Crime No. 265 of 2017 dated 22.12.2017 for the offecnes under Sections 379 of the Indian Penal Code, 1860, and 21(1) of Mines and Minerals (Developement and Regulation) Act, 1957, by the second respondent. 3.The learned Government Advocate for the second respondent submits that charge has been prepared and will be filed in due course. 4.Considering the fact that no charge sheet has been filed till date, there can be no impediment in directing the first respondent for issuance of 2/5
passport to the petitioner in response to the petitioner's passport application bearing File No. TR1075132834525 dated 04.06.2025. 5.Under these circumstances, the first respondent is directed to process the passport application of the petitioner and issue passport to the petitioner as expeditiously as possible preferably within a period of four weeks from the date of receipt of a copy of this order.
6.It is also made clear that in case charge sheet is filed against the petitioner in due course, the petitioner shall surrender the passport before the concerned court and retrieve the same as and when the petitioner proposes to travel abroad by filing appropriate application. If the petitioner fails to comply with this condition, the first respondent is at liberty to cancel the passport.
7.The writ petition stands disposed of with the above liberty. No costs. Consequently, the connected miscellaneous petition is closed. 21.07.2025 NCC : Yes / No Index : Yes / No Internet : Yes / No 3/5
