PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the 2nd respondent not to harass the petitioner in the guise of enquiry at the instigation of the respondent Nos.3 to 7.

For Petitioner : Mr.C.Jeyaprakash For R1 & R2 : Mr.B.Thanga Aravindh Government Advocate (Crl.side) O RDER This petition is filed seeking for a direction to the respondent No.2 police not to harass the petitioner basing on a complaint allegedly given by the respondent Nos.3 to 7.

2.According to the learned counsel for the petitioner, the petitioner is a money lender doing money lending business after obtaining due licence and permission and it is submitted that there is a dispute between the petitioner and the unofficial respondent Nos.3 to 7 in respect of a immovable property. Taking that dispute as an advantage, the unofficial respondents have filed a false complaint alleging that the petitioner has been collecting huge interest. 2/5

3.The learned Government Advocate (Crl.side) on the other hand submits that the complaint of the respondent No.6 is registered as C.No.N4/15920/1753/2020 dated 11.07.2023 and notice has been issued to the petitioner, however the petitioner failed to appear. 4.Considering the circumstances, this Petition is disposed of directing the petitioner to appear before the respondent police in the enquiry in C.No.N4/15920/1753/2020 dated 11.07.2023 and the respondent police are directed to register a case against the petitioner, in case if he has committed any offence under any of the enactments. If not, the respondent police are not expected to intervene in the civil dispute between the parties and to dispose of the representation of the respondent No.6 dated 25.07.2023 within a period of 2 weeks from the date of receipt of a copy of this order.
