Heard both sides.
2.Sale deed dated 27.06.2025 was executed in favour of the writ petitioner by Sudhakar, S/o.Ashok Chander. The document was presented for registration. Citing the bar under Section 22A of the Registration Act, 1908 registration was refused. Challenging the same, this writ petition has been filed.
3.It is seen that an extent of land measuring 90 cents originally belong to Ponnambalam Nadar. He was blessed with two sons, namely, Ashok Chander and Balasubramanian. 70 cents of land was partitioned between Ashok Chander and Balasubramanian on 11.06.1997. 2/5
Subsequently, in the year 2007, Balasubramanian dealt with the properties contained in the petition mentioned survey number. In fact, the lands were treated as house site. Only in the year 2022, there was a partition in the family of Ashok Chander. Ashok Chander was blessed with 3 children, namely, Sudhakar, Dhinakar and Kavitha. The petition mentioned property was allotted in favour of Sudhakar as 'A-schedule' property in the family partition dated 13.04.2022 (Document No. 922/2022). The property allotted in favour of Sudhakar is the subject matter of the present transaction.
4.The petitioner gives an undertaking before this Court that without getting approval from the competent authority, no construction will be made in the petition mentioned land.
5.Recording the said undertaking and considering the fact that the property now sold was already subject matter of registered agreement, the impugned refusal check slip is quashed. The parties are permitted to re-present the document. It shall be registered and released subject to the fulfilment of the other usual formalities.
