ORDER

Heard Mr.C.Kannathasan learned counsel for the petitioner and Ms.P.Sudarkodi Natchiyar, learned counsel for the State of Tamil Nadu, for the respondents.

2.After hearing the learned counsel for the petitioner and the learned counsel for the respondents, this writ petition is disposed of at the time of admission itself.

3.The petitioner appears to have purchased the property in S.No.90/6 (old S.No.55/9) in Kulamangalam Village, Madurai District on 16.06.1999. The said sale deed was registered as Doc.No.1308/1999. It appears that the entire area of Kulamangalam village was reclassified as Residential Class-IV Type-I. 2/5

4.It is submitted that the petitioner is proposing to execute a gift deed in favour of her son. However, the land value has been increased manifold time in view of the reclassification of the survey number from Wet Channel Irrigation Double Crop Type-II to Residential Class-IV Type-I. It is submitted that neither the petitioner nor her son intent to alter the usage of the land and that the land is being used only for paddy cultivation.

5.The learned counsel for the respondents would submit that in this connection, the petitioner has given a representation, dated 29.05.2026 enclosing the Adangal and other documents to establish that the petitioner was carrying on agricultural activity in the said land and that the land has not been utilized for any other purposes other than for agricultural purposes. 6.The learned counsel for the respondents submits that the respondents will conduct a field survey and will examine as to whether the property indeed has been utilized only for agriculture purposes, as prima facie the petitioner has produced copies of Adangal and thereafter, appropriate decisions will be taken 3/5

and the petitioner's aforesaid representation dated 29.05.2026 will also be considered.

7.Recording the submission of the learned counsel for the respondents, this Writ Petition stands disposed of, by directing the first respondent to pass appropriate orders on the petitioner's representation dated 29.05.2026 within a period of six weeks from the date of receipt of a copy of this order. Needless to state, the petitioner shall be heard before final decision is taken, if the petitioner so desires. No costs.
