ORDER

The petitioner seeks police protection to him.

2. Heard the learned counsel on either side.

3. The learned counsel for the petitioner submits that the petitioner is the the owner of the property. In fact, third parties have filed suit against the petitioner for specific performance. The private respondent who has no right title or interest, whatsoever in the said property, is trying to interfere with the property by threatening the petitioner and hence the complaint.

4. The learned Government Advocate (Criminal Side) would submit that the complaint was treated as a petition and during the enquiry, both sides have given in writing that they will take remedies from the appropriate civil Court, accordingly, the petition is closed.

5. In view thereof, when the third party is persistently attempting to interfere with the possession and enjoyment of the petitioner's

property, it will very well be open to the petitioner to approach the appropriate civil Court and depending on the interim order or decree of the Civil Court, they can again approach the respondent police and the respondent police can grant protection only as per the order of the Civil Court.

6. With the above liberty preserved to the petitioner, this Petition stands disposed of.
