given by this Honourable Madurai Bench in its order dated 27.07.2023 in Cont. P (MD) No.1093 of 2023 .

PRAYER IN CONT P(MD).NO.1093 OF 2023:- Contempt Petition filed dunder Section 11 of the Contempt of Courts Act,1971,to pass an order by punishing the Contemnor/Respondent for his willful disobedience of the order passed by this Hon'ble Court in Crl.O.P.(MD)NO.4905 of 2020 dated 12/01/2022.

ORDER:- This Revision/Appeal Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr. R.Meenakshi Sundaram,Additional Public Prosecutor for the Petitioner and of Mr.K.Muthumalai, Advocate for the respondent, this Court made the following order:

This petition has been filed seeking six months time to complete the investigation and to file the final report before the concerned Court as per direction of this Court in Cont.P(MD).No.1093 of 2023 dated 27.07.2023.

2. On 09.08.2024, this Court called for the report from the Secretary, District Legal Services Authority, Madurai, as to why the documents sought for have not been furnished to the Investigating Officer.

3. Report has been received from the Distric Legal Service Authority, it reveals that while shifing the office, the bundle was misplaced and now it was traced out. Thereafter, intimation was sent to the first petitioner and the first petitioner appeared on 22.08.2024 and collected some documents.

4. The learned Additional Public Prosecutor appearing for the petitioners seeks six months time to complete the investigation.

5. In view of the above said development and considering the request made by the learned Additional Public Prosecutor three months time is granted to complete the inveestigation. Accordingly, this Sub Application is allowed and liberty granted to the respondent, if the order is not complied with within a time, he can move a fresh application.
