Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of certiorarified mandamus, to call for records relating to the impugned order of the 1st respondent in Na.Ka.No. 8915/2023/A2, dated 24.06.2024, and quash the same and consequently direct the 2nd respondent to restore the patta Nos.9094 and 9047 in respect

of S.Nos.393/1A2 and 393/2A1, Thimmarasanaickkanur Village, Andipatti Taluk, Theni District, in the name of petitioners. For Petitioners :

ORDER

The Writ Petition is filed, challenging the order passed by first respondent, cancelling the patta issued in the name of the petitioner, and restoring the revenue records as they stood prior to mutation in favour of the petitioner.

2. Against the impugned order passed by Revenue Divisional Officer - first respondent, the petitioner has a remedy of revision before District Revenue Officer under Section 14 of the Tamil Nadu Patta Pass Book Act.

3. A reading of the impugned order would establish that the impugned order was passed, after issuing notice to petitioner and respondents therein, and both of them participated in the enquiry before first respondent. Therefore, there is no violation of principles of natural justice. In these circumstances, this Court is not inclined to entertain the writ petition, when there is an alternative remedy of revision available to the petitioner.

4. Accordingly, the Writ Petition stands dismissed, with liberty to the petitioner to avail alternative remedy of revision before District Revenue Officer. It is open to the petitioner to raise all the points raised by him in this writ petition, including the point of limitation, before the revisional authority. No costs. Consequently, the connected W.M.P.(MD) Nos.14884, 14885 and 14886 of 2025 are closed.
