PRAYER: Civil Revision Petition is filed under Article 227 of Constitution of India, to direct the learned Sub Judge, Thirumangalam to expedite the execution application in E.A.No.1 of 2024 in E.P.No.78 of 2012 in O.S.No.319 of 2006 on the file of the I Additional Sub Court, Madurai, within a time frame as may be stipulated by this Court.

ORDER

This petition has been filed seeking a direction to the learned Sub Judge, Thirumangalam to expedite the execution application in E.A.No.1 of 2024 in E.P.No.78 of 2012 in O.S.No.319 of 2006 on the file of the I Additional Sub Court, Madurai, within a time frame as may be stipulated by this Court.

2. Since no adverse orders are going to be passed against the respondents, notice to the respondents is dispensed with.

3. The petitioners are legal heirs of one Subramaniyan. The above said Subramanian filed a suit in O.S.No.319 of 2006 before the I Additional Sub Court, Madurai seeking specific performance against the respondent and the same was decreed in his favour on 27.11.2006. Thereafter, the above said Subramanian filed an execution petition in E.P.No.78 of 2012 before the learned Sub Judge (Camp Court), Thirumangalam. The above said Subramanian met with an accident and unable to communicate with his counsel and the Execution Petition was dismissed for default on 09.11.2016. In the meant time, the above said Subramanian died on 12.05.2021. Immediately thereafter, the petitioners herein filed an Execution Application before the Sub Court, Thirumangalam and the same was numbered as E.A.No.1 of 2024. 2/4

The learned counsel appearing for the petitioners would submit that this Court may issue a direction to the Sub Court, Thirumangalam, to expedite the execution application in E.A.No.1 of 2024 in E.P.No.78 of 2012 in O.S.No. 319 of 2006 within a time frame fixed by this Court. 4.. In view of the said submission made by the learned counsel appearing for the petitioners, the Sub Court, Tirumangalam is directed to dispose of the petition in E.A.No.1 of 2024 in E.P.No.78 of 2012 in O.S.No.319 of 2006 within a period of three months from the date of receipt of a copy of this order.
