Respondents PRAYER : Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the 5th respondent to issue no objection certificate to the petitioner and subsequently direct the 2nd respondent to register the petitioner's power of attorney dated 14.03.2025 in respect of his plot no. 43, patta no. 4431 in Survey No. 602/31 at Ilanji Village, Tenkasi Taluk, Tenkasi District forthwith.

ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus, directing the 5th respondent to issue no objection certificate to the petitioner and subsequently direct the 2nd respondent to register the petitioner's power of attorney dated 14.03.2025 forthwith.

2. It is seen from the records that the 2nd respondent has refused to register the petitioner's power of attorney dated 14.03.2025 since the land belongs to the temple. This issue was already considered by this Court in the case of 2/5

Sudha Ravi Kumar and Another Vs. The Special Commissioner and Others in W.P.Nos.30589 of 2013 and batch, dated 05.04.2017, wherein it is directed to issue notice to the petitioner and the temple and conduct enquiry and pass orders.

3. Therefore, the 2nd respondent is directed to conduct an enquiry and pass orders in accordance to law.

4. With the above observations, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
