O R D E R

[Order of the Court was made by M.DURAISWAMY.,J.] The petitioner has filed the above Writ Petition to issue Writ of Certiorari, to call for the records of the respondent notice, dated 13.10.2021 and to quash the same.

On a careful consideration of the materials available on record and the submissions made by the learned Counsel for the petitioner, it could be seen that the petitioner had already filed two Writ Petitions, namely, W.P(MD)No.12643 of 2019 and W.P(MD) No.23453 of 2019. The Division Bench of this Court by order, dated 29.05.2019, disposed of the Writ Petition in W.P(MD)No.12643 of 2019 and another Division Bench of this Court dismissed the Writ petition in W.P(MD)No.23453 of 2019, by order, dated 07.11.2019.

3. Now, for the third time, the petitioner has filed the Writ Petition challenging the notice, dated 13.10.2021. Even while dismissing the earlier Writ Petition in W.P(MD)No.23453 of 2019, the Division Bench observed that the earlier notice was issued to the petitioner's wife and she was not success in getting the notice set https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P(MD)NO.19415 of 2021 aside. Therefore, the petitioner has filed the Writ petition.

4. The said Writ petition was a second round of litigation challenging the notice, dated 08.05.2019. Now, for the third time, the petitioner has challenged the notice, dated 13.10.2021. The petitioner cannot be allowed to file Writ petition after Writ Petition challenging the notices issued by the respondents.

5. In such view of the matter, we are not inclined to entertain the Writ petition.

6. Accordingly, the Writ Petition is dismissed, with cost of Rs.10,000/-. The petitioner is directed to pay the cost of Rs.10,000/-(Rupees ten thousand only) to the respondent, within two weeks from the date of receipt of a copy of this order.
