PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying to direct the learned Sessions Judge (FAC), Special Court for Trial of cases registered under SC/ST (POA) Act, Srivilliputhur, Virudhunagar to consider the petitioners bail applications on the same day of surrender in Crime No. 183 of 2022 dated 21.02.2022 on the file of the second respondent police.

This Criminal Original Petition has been filed to direct the learned Sessions Judge (FAC), Special Court for Trial of cases registered under SC/ST (POA) Act, Srivilliputhur, Virudhunagar to consider the Petitioners bail applications on the same day of surrender in Crime No. 183 of 2022 dated 21.02.2022 on the file of the second respondent police

2. It is the submission of the learned Counsel for the Petitioners that the Petitioners herein are landlords and they had instituted Rent Control Original Petition to evict the tenant for arrears of rent and the said petition was allowed. Only to evade from the due process of law, this petition has been filed invoking the provisions of SC/ST Act.

3. The learned Government Advocate(Crl.Side)would submit that the case arises out of tenancy dispute and the injured has been discharged from the hospital.

4. Considering the submissions made by the learned Counsel for the Petitioners, this Criminal Original Petition is allowed. The Petitioners are directed to surrender before the learned Sessions Judge (FAC), Special Court for Trial of cases registered under SC/ST (POA) Act, Srivilliputhur, Virudhunagar District within 15 days from the date of receipt of copy of this order.
