Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the first Respondent to reissue/renew the passport bearing No.J0277724 to the Petitioner by processing his application in file No.TR1077118369924 based on the Petitioner application dated 14.11.2024. ORDER

This writ petition has been filed for a writ of Mandamus to direct the first respondent to reissue/renew the passport bearing No.J0277724 by processing his application dated 14.11.2024.

2. It appears that two FIRs have been registered against the petitioner as detailed below:

3. The learned Government Advocate for the second respondent submits that the petitioner has been arrayed as an accused in the abvove two cases. In both cases, the investigation has been completed. However, no charge sheet has been filed.

4. Considering the same, there can be no impediment for issuance of passport by the first respondent.

Under these circumstances, the first respondent is directed to process the petitioner's passport application to issue passport within a period of 6 weeks from the date of receipt of a copy of this order. In case charge sheet is filed, the petitioner shall surrender the passport before the concerned court and thereafter retrieve the same as and when the petitioner proposes to travel abroad by filing appropriate application.

6. It is made clear that in case the petitioner fails to surrender the passport before the concerned Court, the first respondent is at liberty to cancel the passport after due intimation to the second respondent.
