PETITION FOR BAIL Under Sec.439 of Cr.P.C PRAYER :- For Bail in Crime No.1037/2020 on the file of the respondent police.
ORDER : The Court made the following order :- The petitioner, who was arrested on 22.07.2020 for the offences punishable under Sections 147, 148, 294(b), 302 and 506(ii)IPC in Crime No.1037 of 2020 on the file of the respondent police, seeks bail.
2.The case of the prosecution is that due to previous motive, the petitioner and other accused attacked the deceased with sword and caused death. Hence, the complaint.
3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner is in judicial custody from 22.07.2020 and hence, he seeks bail. 4.The learned Additional Public Prosecutor appearing for the respondent police, on instructions, would submit that the petitioner earlier moved a petition for anticipatory bail and the same was dismissed on 12.10.2021 citing the bad antecedents of the https://hcservices.ecourts.gov.in/hcservices/ 1/2

He would further submit that there is no change in circumstances and the co-accused, who were granted bail, are absconding and trial in this case is not yet commenced. Hence, he strongly opposed to grant bail to the petitioner. 5.Considering the bad antecedents of the petitioner and also considering the fact that earlier petition filed by the petitioner was dismissed only on 12.10.2021 and there is no change in circumstances, this Court is not inclined to grant bail to the petitioner. Accordingly, this criminal original petition is dismissed.
