PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, to direct the respondents 1 and 2 to release the petitioner's land with an extent of 1 acre 58 cents in Survey Number: 70/6, 70/10 and 70/11 situated at Kochadai Village, South Madurai Taluk, Madurai District, which was earmarked for the "Kochadai Detailed Development Plan part-7" (Map No.4 and 5) by treating the "Kochadai Detailed Development Plan part-7" (Map No.4 and 5) as lapsed under Section 38 of the Tamil Nadu Town and Country Planning Act, 1971.

ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the respondents 1 and 2 to release the petitioner's land with an extent of 1 acre 58 cents in Survey Number: 70/6, 70/10 and 70/11 situated at Kochadai Village, South Madurai Taluk, Madurai District, which was earmarked for the "Kochadai Detailed Development Plan part-7" (Map No.4 and 5) by treating the "Kochadai Detailed Development Plan part-7" (Map No.4 and 5) as lapsed under Section 38 of the Tamil Nadu Town and Country Planning Act, 1971. 2.The learned Counsel appearing for the petitioner submitted that already this Court has passed an order to release the land for the Kochadai Detailed Development Plan part-7. However, the learned Additional Government Pleader appearing for the 1st respondent submitted that the petitioner has not submitted any representation.

3.The learned Counsel appearing for the petitioner contended that the said submission is incorrect, since the petitioner has already submitted a representation dated 08.07.2025.

4.Since the acknowledgement card is not submitted before this Court, this Court is directing the petitioner to submit another representation within a 2/4

period of two weeks from the date of receipt of a copy of this order and the respondents shall consider the petitioner's representation within a period of six weeks there from. The representation shall be considered in the light of the order passed in W.P.(MD)Nos.14456 and 14600 of 2014, dated 27.02.2017. 5.With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
