: Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records of the impugned order passed in Ref.GIRH/ESTT/2022-23/0222 dated 22.06.2022 by the second respondent institute and quash the same as illegal and consequently direct the second respondent to extend the period of petitioner's service from the age of 59 years to 60 years as per the Clause 16 and 19 of the Reframed Service Rules, 2003 of the 2nd respondent institute along with all pay protection, continuation of service and all other benefits applicable to the petitioner.

This Writ Petition has been filed primarily seeking extension of the petitioner's service from the age of 59 years to 60 years.
2.It is now brought to the notice of this Court by the learned Standing Counsel for the respondent institute that the period of extension sought for by the petitioner has already come to an end on 31.05.2022 and therefore, nothing survives for further adjudication in this Writ Petition. However, learned Counsel for the petitioner would submit that the petitioner is still entitled for pay protection and other benefits for the extended period. 3/7
3.Learned Standing Counsel for the respondent institute also submits that all the pay benefits payable to the petitioner has already been paid.
4.No prejudice will be caused to the respondents if the petitioner is allowed to give a representation for the said purpose and the respondents are directed to consider the same on merits and in accordance with law within a time frame to be fixed by this Court. 5.Since the extended period sought for by the petitioner in this Writ Petition has already come to an end, nothing survives for further adjudication in this Writ Petition. However, liberty is granted to the petitioner to submit fresh representation to the respondents seeking for pay protection and other benefits payable to the petitioner for the extended period within a period of two [2] weeks from the date of receipt of a copy of the order. On receipt of the said representation, the respondents shall consider the same on merits and in accordance with law and pass final orders within a period of eight [8] weeks from the date of receipt of a copy of the representation.

6.With the aforesaid direction, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
